01 Acceptance of Terms

By downloading, installing, or using Passion Audio Player (the "Software"), or by accessing or using the website at passionplayer.com and its subdomains (the "Website"), you agree to be bound by these Terms of Service ("Terms").

These Terms form a legally binding agreement between you and George Boudouris (the "Operator"), the sole developer and maintainer of Passion Audio Player. If you do not agree to these Terms, do not use the Software or Website.

These Terms apply in addition to any other agreements or policies referenced herein, including the Privacy Policy.

02 Software License

Passion Audio Player is distributed as freeware. Subject to the restrictions in Section 3, the Operator grants you a personal, non-exclusive, non-transferable, royalty-free license to:

• Download and install the Software on any number of devices you personally own or control.
• Use the Software for personal, educational, or commercial listening purposes.
• Share unmodified copies of the official installer or portable archive with others, provided you do so free of charge and link to the official website.

This license does not transfer any ownership of the Software to you. The Software remains the intellectual property of George Boudouris at all times.

The Software is not open-source. You may not decompile, reverse-engineer, or disassemble the Software except to the extent expressly permitted by applicable law. If you are a researcher or developer with a legitimate need to inspect binary behaviour, please contact the Operator before proceeding.

03 Restrictions

You may not:

• Sell, sublicense, or commercially redistribute the Software or any modified version of it.
• Bundle the Software with any commercial product or paid service without prior written permission from the Operator.
• Modify the Software's executable, resources, or installer and redistribute the result as if it were an official release.
• Remove, obscure, or alter any copyright notices, trademarks, or other proprietary markings within the Software or its documentation.
• Use the Passion Audio Player name, logo, or branding to endorse or promote third-party products or services without prior written consent.
• Distribute the Software via channels that bundle it with adware, spyware, or any software the recipient has not consented to install.

Violations of these restrictions may result in legal action and will be pursued where appropriate.

04 Plugins & Skins

The Operator provides a public plugin and skinning API that allows third parties to create extensions for the Software. The following terms apply to community-developed plugins and skins:

• Third-party plugins and skins are independent works. The Operator does not review, endorse, or take responsibility for any third-party extension not explicitly listed on the official downloads page.
• You install third-party plugins at your own risk. The Operator is not liable for any damage, data loss, or security issues caused by third-party extensions.
• If you develop a plugin or skin and distribute it, you are responsible for ensuring it complies with applicable laws and does not infringe on third-party intellectual property.
• Plugins or skins submitted for official listing on this website must be your own original work and must not contain malicious code. The Operator reserves the right to refuse listing at their sole discretion.
• The Operator does not claim ownership of community-developed plugins or skins. Copyright remains with the respective author unless explicitly stated otherwise.

05 Website Use

You may access and use the Website for lawful purposes only. You agree not to:

• Attempt to gain unauthorised access to any part of the Website, its hosting infrastructure, or associated systems.
• Use automated tools (scrapers, bots, crawlers) to harvest content or data from the Website in a manner that places unreasonable load on the server.
• Transmit or upload any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
• Impersonate the Operator, another user, or any other person or entity.
• Attempt to disrupt the availability of the Website (e.g. denial-of-service attacks).

The Operator reserves the right to block access to the Website for any user who violates these terms or who poses a security threat, without prior notice.

06 Forum Conduct

The community forum is a space for respectful, constructive discussion. By participating you agree to:

• Treat all other members with courtesy and respect, regardless of their experience level or opinion.
• Post only content you have the right to share. Do not post copyrighted material without permission.
• Not post spam, unsolicited commercial messages, or referral links.
• Not post content that is hateful, discriminatory, sexually explicit, or that harasses any individual.
• Accept moderation decisions made by the Operator in good faith. Moderators may remove, edit, or move posts and ban accounts that violate these terms.

You retain ownership of content you post. By posting, you grant the Operator a non-exclusive, royalty-free license to display and archive that content for the operation of the forum.

07 Intellectual Property

All original content on the Website — including but not limited to text, graphics, the Passion Audio Player name and logo, page layouts, and documentation — is the intellectual property of George Boudouris and is protected by applicable copyright and trademark law.

You may link to any page on the Website freely. You may quote brief passages from documentation for review, commentary, or educational purposes (fair use / fair dealing), provided you attribute the source clearly.

You may not reproduce substantial portions of the Website's content, publish mirror copies, or re-upload the Software to other distribution platforms without prior written permission from the Operator.

08 Disclaimer of Warranties

To the fullest extent permitted by law, the Operator disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

The Operator does not warrant that:

• The Software will operate without interruption or be free of bugs or defects.
• The Software will be compatible with every operating system, hardware configuration, or third-party application.
• The Website will be available at all times or that its content will be accurate and up to date.
• Any defects in the Software will be corrected within any particular timeframe.

09 Limitation of Liability

To the maximum extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Software or Website, including but not limited to:

• Loss of data, files, or audio library metadata.
• Damage to hardware or other software caused by use of the Software.
• Business interruption or loss of revenue.
• Any claim arising from third-party plugins or skins you have installed.

In jurisdictions that do not permit the exclusion or limitation of certain liabilities, the Operator's liability is limited to the greatest extent permitted by law. Because Passion Audio Player is provided free of charge, the maximum aggregate liability of the Operator to you shall not exceed €10 (ten euros).

10 Indemnification

You agree to indemnify, defend, and hold harmless the Operator from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your violation of these Terms.
• Your violation of any third-party right, including intellectual property or privacy rights.
• Any content you post on the forum or submit via the contact form.
• Any plugin or skin you develop and distribute that causes harm to third parties.

11 Termination

The Operator may terminate or suspend your access to the Website and forum at any time, without notice, for conduct that violates these Terms or is otherwise harmful to other users, the Operator, or third parties.

Upon termination of your forum account, your right to post is revoked. Existing publicly visible posts may be retained for continuity of discussion threads at the Operator's discretion, or deleted upon your request.

Your right to use the Software itself is not affected by termination of website access unless you have been found to have violated Section 3 (Restrictions), in which case the Operator may revoke your license to use the Software.

12 Governing Law

These Terms are governed by and construed in accordance with the laws of Greece, without regard to its conflict-of-law provisions. You agree to submit to the personal jurisdiction of the courts located in Athens, Greece for the resolution of any dispute arising from these Terms.

If you are a consumer resident in the European Union, you also retain the benefit of any mandatory protective provisions of the laws of your country of residence.

13 Changes to Terms

The Operator reserves the right to modify these Terms at any time. When changes are made, the "Last updated" date at the top of this page will be revised. Continued use of the Software or Website after revised Terms are posted constitutes your acceptance of the updated Terms.

Material changes — such as changes to the software license or liability clauses — will be announced on the website homepage and, where appropriate, in the community forum.
